Atleast this new rule would help speed up that process. 45 days is certaily achievable. attorney must do a good job while asking for the documents upfront.
I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. EB-3 India is last in the line so first EB-2 (WW) than EB-2 India/china/mexico, then EB-3 (WW) then EB-3 India/China/Mexico... basically my common sense tells me EB-3 India will get a big 'ZERO'....

I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.
There could be some background processing going on.
Is there are pattern to these LUDs?
What steps did you take after the NOID on your 485? Just curious in case it happens to me.

After reading through all the posts at IV, I've decided to get the Atlas America Medical insurance for my parents. This is the only comprehensive insurance I could find and most others have limited coverage. The cost is around $900 for 3 months for a $500000 policy with $2500 deductible.
Could members who had this insurance post their experience?
Also, is there any other comprehensive plan available for visitors?
we used IMG international's/sirius international patriot america with a $250 decutible 90/10, for 50K...
one thing I noticed is this company takes a long time ( most other visitor insurance companies too I suspect) for settling cliams..we still have a claim not settled since for a one in december and most of these dont cover pre existing conditions and they are very very restrictive.. however there are some insuranc companies who provide a rider for pre existing conditions for an extra dough..
just make sure to call them for any major visit (hopefdully not needed but in any case) , the one above we got was a comprehensive NOT a limited one..still I think these insurance carriers in my opinion do their best to delay the claim and do whatever they can to sneak up on you with a surprise

I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.

Today 10/16/2007 there is another update. Why is USCIS looking at my old H1B approved in August 2003 for an employer I left in 2004? I am perplexed!

One step closer.
With last year crisscrossing, EB2 India most apps are cleared upto september 2004. We should not have too many in 2004 except substitution cases.
Hope it will step into 2005 in next 4 months....
I might be wrong, but I think EB2 India came only uptil April 2004.

I know how it feels when guys out there with priority date later than you get approved and you're stuck in this black hole with no clue on what the current status is.
Usually, it takes atleast 7 days for the congressman staff to get any response. It's always better to call the staff casually after couple of days to make sure they have got all the paper work you've sent and they are working on it.
I'm sure your case will be approved soon - have hope.

There are many deep pockets and if there was any such arbitrague existing people will mint money all day long. Rupee is not fully floating currency that doesn't mean you can control what the exchange rate is going to be. No company or congolmerate can manipulate market like that.

Well if we were to carry your reasoning a little bit further ...being a citizen of a country, any country, is only a privilege and not a right as you have to follow the rules and laws of the country.
The actual difference is in the definition as has been pointed out earlier.....
"right" - is something you can ask for because you think it is reasonably fair
"privilege" - is something you are not entitled to or deserve but nevertheless get because someone condescended to give it to you.
By the above definitions what would would classify getting permanent residence as.... the answer lies in the broader way of how we look at life and live it.
Do we always live in fear and cower in front of real and imagined threats - the GC is then a privilege.
Or do we live an honest life - do the best we can - and stand up for what we think is right or wrong irrespective of whether our lives are directly affected or not. The GC then is a right.
Getting a GC in United States is our dream. Following rules and following laws of the system is all what we can do. We can only highlight the defects in the system and ask for a change.
We live a honest life not out of fear of getting caught, but because we believe that that is the right thing to do.
If you are a citizen and stand up for what is right or wrong, then the concerned authorities should seriously look into it.

I believe that there is a great flaw in the way the USCIS allocates VISA NUMBERS among EB1, EB2 and EB3 which is very much evident and if we can stand united we can get something done.
After carefully observing the trend in VISA approval and VISA bulletins, It is a reality that EB3-I is not moving and at the same time EB2 and EB1 are moving fast in relative terms and probably may even become current ( EB1 is already current ), But one thing USCIS is clearly not considering is the Priority Date, which basically means that they are not giving a damn thing about how long the person from EB3-I is waiting for. Here is my suggestion and some of the IV representatives need to analyse what Iam gonna say and see if they can stand up. Being an EB3-I india myself, i totally agree that EB1 and EB2 should be given a weightage and some preference over EB3, but I dont agree to what USCIS is currently following, EB2 With priority 2006 getting ahead of EB3-I with priority date 2001. This is ridiculous and to even think about it, it just sounds stupid. What they can do is , They can move the Dates in both Categories while giving preference to EB1 and EB2 first.
Please dont jump up & down before i complete. Iam just giving you an example of how things should work and how they can move dates forward for all 3 categories while maintaining that EB1 and EB2 gets preference over EB3. Let us ignore Eb1, since it is already current. Now Coming to Eb2, the priority Date is 2004 for them.Ideally speaking, They should not move them ahead until atleast EB3 reaches 2004. But once Both EB2 and EB3 reaches the priority date of 2004, Obviously EB2 gets the preference over Eb3 and EB2 will start to move ahead but not by much, let us say 1 year. Now, Clearly, EB2 is still given the extra preference over EB3 but at the same time, we are maintaining the priority dates between EB2 and EB3 as close as possible so that the system is not totally unfair to EB3 filers. I think, as one of the un-biased Organisation we should stand up against this unfair treatment in general. I hope even EB-2 will understand what iam trying to say.
