Is the writing still not clear on the wall. There is so much opposition here to our action against Eb3 -> Eb2 porting, from all this people who are in the process of porting.

This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

We are 74 contributors to this campaign by my count...and not everyone posts here...not to mention 4 outstanding challenges that must be met :D
Thank you all for responding to my request, i feel honored to be a part of this group. 74 out of 3,000 members is still a drop in the ocean though, please continue to encourage all the bystanders, contact friends, post on active threads, whatever it takes...we need this...for us.
Don't forget the add a member drive either, we still have a way towards the goal of 10,000 members!

Here is the dilemma.... The Idea is great...It can change our lives But if we sit on the idea for long it will rot So DO WE TAKE ACTION or LET US WAIT FOR CORE TO COME UP WITH SOLUTION. I would suggest we form a small committee or group of people who can brainstorm and come up with possible course of actions and then present the idea to core.
This is similar to House->Judiciary committee -> Immigration sub Committee
idea is to analyze the situation and come up with the best solution rather than waiting for
CORE to act on.

I am posting this story sent by a person literally wasting her skills away as an H4 visa holder. I am sure lots of IV members and their spouses can relate to this.....
All those who are suffering like this please consider contributing to IV and we request members to join in doing action alerts, Letters to Editors and participate in forums
Here it goes
I have about 7 years of experience as a project manager in Environmental Engg and a BS from a very reputed school but my visa status doesnt permit me to work. Recently, I had to let go of a wonderful job offer because I didnt have EAD and was not even eligible to apply for H1 work permit, having used up 6 years of H status (the employer was ready to sponsor). That leaves me no option but wait for backlog to be cleared or Plan B- move back home. With retrogression, it would take atleast two more years to get my EAD. That would take away 8 years of my productive time in life. All these 6 years, I have volunteered in different non-profit organisations by developing and maintaining their websites. I am also volunteering in my son's school. We have been paying our taxes, donating to Firemen, Policemen etc. It is frustrating that we are giving to the community and not getting basic work permit in return.
How US will benefit if you remain here (competitiveness angle) -

Hi Guys
I would like to point out a few things about the recent Lobby day we from IV did on June 6th and 7th in Washington DC.
I am a proud participant and I am glad I did take part in it. This was my first time and I am ready to this again when needed. Initially I was skeptical about this drive like a lot of you . But after I saw the commitment and dedication of our senior members , I am encouraged and I am glad I went there to DC and I was surprised how positive was the response I got from the offices of senators and congressmen and congresswomen. There were a lot of IV members who traveled from all across the country although there were a few states from where members could not make it to DC. Thanks to all of those who attended this event and those who attended know how much positive feeling we had on those 3 days.
In my opinion we were successful in bringing the attention of various congressmen/congresswomen and senators to the issue of employment based green card backlogs. A lot of the senators offices were already aware of what IV is doing and in some cases when we said we are from IV, They started telling why we were there and they were very supportive of our cause.
Some of them had no idea what we were talking about. They think that there is no such thing as backlog in green cards for high skilled immigrants from some countries like India and china and Philippines etc.. We had to educate them and explain the entire green card process steps to their legal aides but towards the end they understood our issue and were supportive of our cause.
Actually a lot of the staffers of senators and congressmen attended the Reception on capital hill on Tuesday. That also underscores the support we have there. To translate the support into more concrete legislative support in our favor, We need to organize more and increase number of members attending these events in future to have a more solid impact on them.
I want to bring up one point very clearly. Guys there is no one in Washington DC offices talking about the difficulties we are facing other than IV organization members . We need to lobby the lawmakers much much before any legislation is drafted and taken up for debate in congress. If we think we will rise up and make some noise when the bill is tabled, we are wrong. By then we will be very very late in the game. The deals would have already be done in congress and our issues will not be addressed at all. ( that is just how business is done in Washington . If you snooze you loose) We need to rise up and take a more active role in IV by
1. Contacting senators and congressmen in our districts and explain to them the issues we are facing , IV Can help you by providing the documentation required and any other help needed in talking to the representatives. ( you will be surprised by their support and positive response to our issues when you meet them )
2. Register and take part in the IV state chapters meetings and discussions
3. Donate what ever we can ( 10 , 20 , 30$ etc..) to our cause in IV . If we can not help ourselves, no one can help us .(keep in mind in DC We would need money to take up any advocacy efforts ).
4. Participate in the lobby drives and other such events to raise awareness about our problems. Numbers really matter in DC . just posting the issues on forums will not help us although it may serve as a consolation by venting out on forums . this will not take us anywhere
Guys please talk to your friends who are in the limbo in EB GC process and get them to actively be involved for our cause. We all will be benefited by the results from the efforts we put in. We all have day jobs at the same time we need to sacrifice some time and resources to the larger cause.
Hope I have inspired my fellow members who are sitting on fence to actively get involved in IV and support our cause.

Given that you are the super moderator, how can you even hint that EB3 vs EB2 reflect skill level of employee - don't you know by now that category is determined by "job's Requirement"?!!!!!!
Also your stereotyping of all EB3s as 3 year Indian degree holder is the most unfortunate - I only hope that rest of the IV leadership is not made up of that crappy idea.
For the record, I hold US Master's degree and am really offended by your comment and your view point.
For the rest of the members reading this topic, this is exactly why being EB3 on IV is becoming more frustrating by the day... especially when the super mods posses such views...

Nss you really have some problem for which you should seek professional help. I am EB2, but I don't go around wining, why I am not EB1, yes the word is winning. I told you yesterday, we didn't make the system and yes I will take the credits for being EB2 because I worked diligently for it, taking student loans and working professional job.
And that job title crap, take it somewhere else, because if that was the case there wouldn't be any Masters or PHD level education, neither there would be STEM. Give credits to our fellow members who come here and work diligently to gain higher education.
And yes, I am sure lot of people will concur with me, the Indian body shop companies, who bring a lot of people from India, abuse the H1b system and file green cards. The EB3 category is a abyss of applications filed for these type of cases.
Next time when you want to argue, keep your facts clear and handy.
Lets drop this topic now, as it serves no purpose. The reason some threads focused on EB2 was because,
1. Number of people stuck in EB2 is higher 2004-2006
2. The back log can be cleared only when, the retrogression can end, I think the cake story didn't make sense to a lot of people.
Lastly please don't post anymore EB2 or EB3, because personally I don't care about that and neither should anyone else. The only way we can bring about this change is through unity and working diligently towards our goals.
All those people who are winning about EB2 or EB2, do some more constructive, how many people did you bring in to IV recently?

Can someone please clarify this to me?
I'm really confused with the rule right now. Since my last entry was Apr 2007 and I worked only from July 2007, was I out of status?
I've read this -
Out of Status is counted only since last entry in US for employment related I-485. And Section 245(k) covers out of status upto 180 days.
And I've read this from somewhere too -
For a new H1B, a grace period of up to 60 days is allowed before you can start work after entering the country.

I would suggest you ask your father to file a writ petition in High Court or Lower Court , my husband did the same for a minor change in his father's middle name.I presume you are indian and Indian authorities have not changed they require a beat down in court then only they work that's my firm belief. In our case it was a simple case my father in laws middle name was misspelt, we had all the evidence they required
school leaving,college leaving,birth certificate,PAN card.
Passport of my father in law where my husband travelled as minor.
Plus we got a letter from District Magistrate/Collector
But still Washington embassy would not budge or entertain our application saying this mistake was not by them and i approach passport authorities in india who had done this .
Finally my husband had enough and my father in law filed a petition in Lower court ,it took a couple of months to get the facts straight ,but it was quicker than we expected. Got a court order attched to application got the correction done.
the problem is we dont approach the law thinking it is headache but the fact is that the issues was not corrected at the right time so we will have get the facts verified by someone credible and who better than law to verify.
And the plus is that no one can refuse your appication and give u the run around ( that you are facing now get this doc get that doc)
as if the consulate does not follow the order it is contempt of court or they can file an appeal against the order . My suggestion would be to go thru courts because the procedures for changes are not crystal clear
but my case is different as i dont have any spe;lings or wrong name.
i need my name to be split in to first name and last name.

My company has applied for H1-B visa for me under the master's quota and premium processing. On the lawyer's website I can see that my application was filed on 3/30 and probably received on or around April 2nd by USCIS.
However, I have not yet received a receipt notice for my application. I am aware that the premium processing deadline is fast approaching and I am getting a little concerned. Is there anybody else out there in a similar situation who has not yet received their receipt notification?
Can anyone advise me on my options? Is there a possibility that the application could have been lost in the mail or something else? Can I re-apply since the master's quota has not yet been filled?

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.

On my 485 receipt, I have RD as 7/20/07, ND as 9/13/07. But when I check my case online, it has 9/12/07.
I had called TSC yesterday and the rep kept telling 9/12/07 and TSC is processing 8/30/07. I told her I have the original receipt in front of me and it says 7/20/07 and not sure where you are getting 9/12 from. She said "Oh I am sorry, I was looking at the incorrect place". She later gave me a SR # and took all the info. The funny part was she even refused to open a SR telling the date was 9/12.
Not sure whether opening a SR now will help but trying does not hurt and it is FREE !!!! Hopefully the officer looks at my file and then approves it.
If you look at my previous posts on this thread, you will get clear picture of what happens. TSC did receive your application on 9/12/07, although USCIS received it on 7/20/07. They entered your data on 9/12/07, and sent out notice the next day. For the two months, it was perhaps lying somewhere with several thousand other applications no one wanted to accept. Mine was received on 7/2/2007, but entered in the system on 10/11/2007.
TSC doesn't care where your file was until they received (and agreed to accept it), which was on 9/12/07. So they say, they (TSC) received it on 9/12/07. Unless somebody has instructed centers to place physical files where they should have been based on the mailroom RD, it is very unlikely that they do anything but place in order they received them i.e. for your case, place your file behind those received (by TSC) on 7/11/07. It is not good, but that's what it is when they say "we process cases in order we receive them" (note that here "we" means the center, not USCIS)

Having diversity AND country quota for skilled employment is affirmative action gone waco. EB skilled immigration is to allow businesses to hire foreign labor for jobs they can't find American Citizens. Now to restrict businesses to discriminate based on the country of birth is just riduculous. Next do Universities apply affirmative action to their international student recruitement?
Indians and Chinese make up the largest group of international students in Engineering and Science. US citizens make up less than 50% of those graduating in Science and Engineering in Master's and PhD programs. Now businesses should not be penalized if they can't fill their highly skilled jobs with Iranians and Tongans and any other ROW countries.
We have a diversity lottery for nationals of those countries who would not make it out on merit and need a leg up. There may be a few Indian consulting companies who favor Indians, but they are the people who pay wages and know best. Similarly just because Americans prefer to buy Japanese cars we can't create an "affirmative action" and prevent americans from buying Japanese cars. We can't prevent walmart from stocking chinese products. So why force employers not to hire Indians and Chinese through creating quotas for highly skilled jobs?
No meaningful immigration reforms can be achieved as long as skilled immigration is based on country quotas. Next we know there will be quotas for marrying foreigners to add to diversity. If you marry a mexican there is retrogression but if you marry a citizen of Vanuatu then green card is processed in ROW:)

I'm not saying it is right. I think there should be no quotas; diversity or otherwise. It should follow normal business practices. Can't find american, we need you now you start working. This is how it works in everyday business.
However; we need to understand why doesn't immigration follow normal business practices. is it that we place more value on our contributions then what the country does. Is EB just another route to get people here like family, asylum, refugees, etc?
Although it may sound ridiculous but why is everyone want to put any limits to it. If proper controls can be put in place that there are genuine jobs and candidates are genuine then there shouldn't be any limits. How come no one wants to go for this solution. It actually makes more sense then just increasing the quota or not including dependents, etc.
