Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

I need to add my daughter's last name to I-485 and subsequent AP. Do I still need to have US court order for doing the same once her passport has correct last name ? How much time does the US court order take and what is the cost ?
Please share if anyone have experience adding the last name with USCIS and how long does it take ?
Look for Name Change document in your local county court. This is fairly quick process and one can use court order indicating name change to update name change in passport and all pending applications at USCIS.
You may need new visa stamp indicating new name.

My PD is May 2006. I applied for I-485 in September 2008 when my date had become current. Subsequently got married and now waiting for my date to be current again so I could add my wife.
I had given hope and was not preparing for anything and hence have India trip planned (wife 11th Sept - 1st Nov and I'd go for the month of October).
Given the latest movement, now I think to be safe I should do all that is necessary that in case dates move forward enough for October, I should be able to add my wife to my application. If there are any comments/advice around this, please do let me know.
Also, what would be the things to get ready for her? I hope it'd be alrite that she will be in India while we apply for her I-485?

The reason for this EB2 move is end of year overflow from other categories. I would not expect a significant forward movement next month (if at all there is ANY forward movement).
If the past experience is any indication, you might see a pullback.
You would know in advance if the dates move forward next month and I guess you can reschedule your visit and cut short your wife's trip.
You can prepare all the necessary documentation like birth certificate (translations if necessary) marriage certificate and/or any affidavits (if necessary) in advance.
I don't think your wife can apply AOS (Adjustment of Status) while abroad. She has to be present in USA. She can however file "Consular Processing" while in a foreign country, if that is what you want to pursue.

A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.

Having diversity AND country quota for skilled employment is affirmative action gone waco. EB skilled immigration is to allow businesses to hire foreign labor for jobs they can't find American Citizens. Now to restrict businesses to discriminate based on the country of birth is just riduculous. Next do Universities apply affirmative action to their international student recruitement?
Indians and Chinese make up the largest group of international students in Engineering and Science. US citizens make up less than 50% of those graduating in Science and Engineering in Master's and PhD programs. Now businesses should not be penalized if they can't fill their highly skilled jobs with Iranians and Tongans and any other ROW countries.
We have a diversity lottery for nationals of those countries who would not make it out on merit and need a leg up. There may be a few Indian consulting companies who favor Indians, but they are the people who pay wages and know best. Similarly just because Americans prefer to buy Japanese cars we can't create an "affirmative action" and prevent americans from buying Japanese cars. We can't prevent walmart from stocking chinese products. So why force employers not to hire Indians and Chinese through creating quotas for highly skilled jobs?
No meaningful immigration reforms can be achieved as long as skilled immigration is based on country quotas. Next we know there will be quotas for marrying foreigners to add to diversity. If you marry a mexican there is retrogression but if you marry a citizen of Vanuatu then green card is processed in ROW:)

We are pretty confident that when our stories passed on to Senators it will definitely benefit us and convey the stark reality. Maybe a jolt like this is what is needed to get them out of stupor
Lets work together to make sure that our sufferings end.

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo
19) I went back an hour later with the print out
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today
26) We waited for 2 hrs and then she took us inside.
27) Asked our passports (to stamp...really)
28) Then she looked into the computer to get the visa #.
29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.

Strange really strange....I am sure RD/ND had not move back and forth so those who applied in late 2007 or 2008....did get approved even though their RD/ND was not current....What nonsense is this...
Now the other thing to worry is FP notice...mine is beyond 15 months and I am sure many are in the same boat....so the wait is longer.....FP and then again NC/BC.....what the &*#$
This is insane....on one hand USCIS is saying it will be decades b4 ppl on EB2 and EB3 (I) will get approved and so ppl will just keep on doing biometrics /apply EAD/AP so added revenue model for USCIS

Man, Don't know how you have time to read all messages in the forum and respond so quick. It's almost like you guys are not human; just machines processing information and acting. This is way beyond a full-time job. It must require so much commitment and probably sacrificing a lot of your personal life.
I just don't know how I can thank you enough for the service you do to the community. I guys have good drive.
All the members have been around through thick and thin. Hats off to every body. I was one of the first few who sent flowers and had no hope that anything would come out of that. It was great. What started with flowers just spread like a fire and here we are.

I applied for passport renewal (Chicago consulate) without name change form. In the Online application, I splitted the name as needed (earlier my name was under Given name). The renewal passport was sent to me with the way I entered the name (splitting) without any additional forms or affidavits.
