I really feel sorry to read this post and the Nanny must be punished for this however as everyone else said you may get into legal trouble if you do report it. My own son is now 5 years old and we use day care services and one of the reason i hate the Nanny concept legal or illegal is because of this abuse and qualifications of the nanny. I strongly suggest find a day care which is reputed has a structured curriculum. Go visit the place and check for cleanliness, talk to the staff etc. Remember some of the day care also bad in terms of hygiene etc. but almost none of them would risk their license by abusing a child. Agreed the child get sick a lot but as immune system develops they get over it and my son really enjoyed all the activities at day care. Nanny at home cannot provide activities needed to keep a child busy thus abuse can happen.
Again i am really sorry to hear. I still think you can anonymously report to DHS or police that the nanny is working illegally if you can do it that way she will get deported and may never get a visa to US.

Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

Instead of wasting time and arguing with others, why don't we start a Blog with this theme. You can put all these facts and the way other countries are doing the immigration process for the professionals. This may attract every one including the Government. In the mean time, we can start sending emails to the Congress men also.
After all these posts your plan of action is to start a blog and send emails to Congress. :D
Is that all you can think of? I suggest you educate yourself first on how laws in Congress are changed. Talk to others who were able to change laws in Congress. Then find out how they did it, money they spent, time it took and people it took.
In this country if you want to do anything via congress you have to lobby. Tell me one bill in this country that was passed because someone created a blog and emailed congress.
After all these posts your plan of action is to start a blog and send emails to Congress. :D

2) We now have atleast 2 more NATIONAL publications who have taken notice of our activities and are more sympathetic to our causes. They feel we have a compelling story and they are interested in publishing about our plight...
In fact two IV members are being interviewed today by a leading publication.
and the most important
3) We got additional material to provide to senators and their staff...this really helps as we do not have to establish ourselves....our stories along with newspaper articles help make our case much stronger....
When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'
Lately when we go to meet them, most of the staff have already visited our sites multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.
So to answer your question, yes it helped a lot

I know I will get red dots for this since you are super moderator, but again IV is a free speech based org, I am a Masters (advanced education) from a very prestigious US university with full scholarship with 4.0 GPA and in EB3 employment category. Eduation and EB catergory are two different things, one would think that would be clear by now.
it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.

So why dont you see that this is not about helping a fellow human being in need. Everyone should do that. The sheriffs dept took her to the hospital to ensure that in case there is any complication, things could be take care of. Why? Because its the law and the majority in this country respect the law. No one, even illegals, can be denied emergent care. This would not happen if she were in Mexico or India. No free medical care there, and no one gives a shit about the rights of prisoners there.
If every one decides to choose for themselves which law they will obey and which they will ignore, society can not exist. And as I pointed out in my previous post, this woman has a history of repeated violations of the law and is NOT a victim that this biased article tries to portray her as.
And your theory about child birth leading to near death like pain is absolutely baseless. I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.
While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.
These are my thoughts!

I have great respect for Paskal. I found your posts to be level headed all the time. Looks like you took this personally this time. This only shows how frustrating these times are. This whole screwed up process is wrong and unfair. Any type of comparison us useless.
There are many factors that determine whether you applied EB2 or EB3. It is not just what your qualifications are. Some companies and attorneys have predispositions. Some companies are very liberal with their job descriptions and some or not. We all know that.
We can draw this argument to many levels.
Experience VS Master's degree
Indian degree vs US degree
Desi Body shop Vs Jobs in reputed companies
Company policy VS bought out LCs
Reputed Schools Vs So So schools
Fact of the matter is , There is still some challenge still in applying under EB1 (although I see many more EB1s these days than I used to). But we practically blurred the lines between EB2 and EB3. That is why people talk about EB2 VS EB3 not EB1 vs EB3.
There are many more qualified folks under EB3 for variety of reasons (who practically gave up any hope) and also some who were in EB2 that are probably not EB2 by strict interpretation and spirit of EB2.
Bottom line : We all screwed. Some more than others :)

it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.
There are many factors that determine whether you applied EB2 or EB3. It is not just what your qualifications are. Some companies and attorneys have predispositions. Some companies are very liberal with their job descriptions and some or not. We all know that.
We can draw this argument to many levels.
Experience VS Master's degree
Indian degree vs US degree
Desi Body shop Vs Jobs in reputed companies
Company policy VS bought out LCs
Reputed Schools Vs So So schools
